    COPYRIGHT / IMAGE ISSUES - Advice Needed

    I have been hired to photograph a May Ball for a local College.  I have received an email saying that for child protection issues, they cannot have any images published on any website.  I do not know if this is their policy or a general issue regarding under 18's.  I wanted to present a selection of images as an example of event work, but I don't know if I'm scuppered now!!! Confused [*-)]

    Any advice / information gratefully received

    I think you will find this is their policy - which as they are hiring you them they make the rules. However, unless you sign away your copywrite to them, then I would suggest they can't stop you asking for permission of individuals and get their agreement in writing (Over 18 will have to sign) and then you can post away.

    But it would depend on the contract.

    Thanks for the reply.  The majority of the guests are going to be under 18, so not sure where I stand with permissions, etc.  Will go back and confirm with them re: policy.  Thanks again.

    If they get you to sign a contract with this clause inserted, then you can't, but if they don't then it's upto you. Big Smile [:D]

    My advice, be careful, just because you have not signed anything doesn't mean it won't turn nasty if you do post them.

    In short you own the copyright, you may verbally or in writing be giving them a 'licence' to use the images themselves but that's a separate issue.

    Are they going to publish them? or are they hoping just for the high res files so that they can sell them on mass for £17 each. This is a common story...

    In short if you want to publish an image get a model release from that person and check against the college finally before doing it, only if however its in school time, on school grounds, or shows clearly the school as an event.

    I am not a lawyer, but i would check with one about the child protection act. It may or may not matter where the shoot was. My advice check with some one who knows, but even if its ok, and legal, you may end up dealing with emotional hostile parents.

    Hi All,

    The college have contacted me now and are going to issue written advice about photographer being present and images appearing on website - any objections please let them know.  So hopefully sorted now Wink [;)]

    That should be interesting - because if some parents object, then it must therefore be assumed that no-one can take pictures - including the students.
